Terms of Use

These Terms of Use ("Terms") govern your use of the BabyCanvas iPhone app (the "App") and this website. By downloading or using the App, you agree to these Terms and to Apple's Licensed Application End User License Agreement (the "Standard EULA"). If there is a conflict, these Terms apply to the extent permitted by the Standard EULA. If you don't agree, please don't use the App.

1. Who can use BabyCanvas

You must be at least 18 years old, or the age of majority where you live, to use the App and purchase a subscription. BabyCanvas is intended for parents and other adults, not for children.

2. The service

BabyCanvas lets you create AI images from photos you provide, including AI Portraits in several art styles, Future Baby images, Look-Alike results, Twin Baby images and Milestone portraits, and edit photos with filters, adjustments, text, frames and crop. We may add, change or remove features over time.

3. Subscriptions and payment

AI creations require a paid subscription. BabyCanvas offers auto-renewing monthly subscription plans (currently Basic, Standard and Premium). The price and what each plan includes are shown in the App before you buy.

  • Payment is charged to your Apple ID account when you confirm the purchase.
  • Your subscription renews automatically at the same price and for the same period unless you turn off auto-renew at least 24 hours before the end of the current period.
  • Your Apple ID account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel your subscription in your iPhone's Settings: tap your name, then Subscriptions. Canceling stops future renewals; your plan stays active until the end of the period you've paid for.
  • If we offer a free trial, any unused part of it ends when you purchase a subscription.
  • Prices may vary by country and may change. Apple will notify you of price increases as required.
  • Payments are processed by Apple. Refund requests are handled by Apple under its policies at reportaproblem.apple.com.

You can restore previous purchases with Restore purchases in the App's Settings, using the same Apple ID.

4. Weekly creations

  • Each plan includes a number of AI creations per week. The number for each plan is shown in the App and may change; changes apply from your next weekly cycle or renewal.
  • Your creations refill every 7 days while your subscription is active. Unused creations do not carry over and have no cash value.
  • Each AI request (for example a portrait set, a Future Baby, a Look-Alike analysis, a twin or a milestone portrait) uses 1 creation.
  • If a generation fails, the creation it used is refunded to your balance.
  • Every plan unlocks all PRO filters and frames in the photo editor while the subscription is active.
  • Creations can't be transferred and end when your subscription ends.

5. Your photos and acceptable use

You may only upload photos that you own or have the right to use, and only photos of people who have agreed, or of children for whom you are the parent or legal guardian or have that person's permission. You agree not to:

  • Upload photos of other people without their permission, or content that is illegal, sexual, violent, hateful or harmful
  • Use the App or its results to harass, deceive, impersonate or defame anyone, or to create misleading content presented as real
  • Upload content that infringes anyone's copyright, trademark, privacy or other rights
  • Try to reverse engineer, scrape, overload, or bypass the limits or security of the App or our servers
  • Resell the service or use it to build a competing product

We may suspend or end access for anyone who breaks these rules, and may remove content that violates them.

6. About AI results

Results are created by artificial intelligence and are artistic images meant for fun and keepsakes. They may be inaccurate, unexpected or imperfect, and similar requests can give different results.

Future Baby, Look-Alike and Twin Baby results are not predictions. They do not show how a real child will look or which parent a child resembles, and they are not genetic, medical, paternity or other scientific analysis. Please don't rely on them for any decision.

7. Content and intellectual property

You keep your rights in the photos you upload. You give us a limited license to store, process and transmit them (including to our AI service providers) only to provide the App to you, as described in our Privacy Policy.

Subject to these Terms and applicable law, you may use the images you create for personal purposes, such as keeping, printing and sharing them with family and friends. We don't claim ownership of your creations.

The App itself, including its design, art styles, filters, frames, text, logos and software, belongs to us or our licensors and is protected by law. The BabyCanvas name and logo may not be used without our permission.

8. Disclaimers

The App is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, including that the App will be uninterrupted, error-free or that results will meet your expectations. Some jurisdictions don't allow certain disclaimers, so some of these may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits liability that can't be limited by law, or your statutory consumer rights.

10. Indemnity

You agree to be responsible for claims arising from photos you upload or from your misuse of the App or these Terms, to the extent permitted by law.

11. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any product claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

12. Ending use

You can stop using the App at any time. Deleting the App doesn't cancel your subscription; cancel it in iPhone Settings. We may suspend or end the service, or your access, if required by law or if you violate these Terms.

13. Changes to these Terms

We may update these Terms from time to time. We'll post the new version on this page and update the effective date, and may notify you in the App about important changes. Continuing to use the App after changes take effect means you accept them.
